Case against Johnston — Prosecution can be charged under Penal Code: GL

SLPP chairman G.L. Peiris said yesterday those who prosecuted the case filed against former MP Johnston Fernando would be held liable to committing a criminal offence under the Penal Code.   
He told a news conference that the Kurunegala High Court had acquitted Mr. Fernando of all charges thus proving he was innocent.   


“The legal proceedings were carried out without calling for the defence to answer the charges nor calling for witnesses to give evidence. The prosecution witnesses were forced to give false evidence in the Courts by the FCID,” Prof. Peiris claimed adding that the documentary evidence was also falsified.

He said the prosecution could also be charged with malicious intent in filing this case.   


Meanwhile, Mr. Fernando said he would take legal action against those who did this injustice and highlighted the fact that this government was carrying out a political witch-hunt by filing such baseless law suits against supporters of the former government.
